DEFINITIONS

The “Supplier” means Furniture Warehouse Sale (ABN 15 004 449 594). The “Customer” means the company/partnership/sole trader who is applying for the credit line facility and includes the Applicant. “I”, “We”, ‘Us” means the Supplier. “You”, “Your” means the Customer.

“Contract;” means the contract for the provision of Goods comprising of these terms and conditions and the Invoice.

“Australian Consumer Law” means schedule 2 of the Competition & Consumer Act 2010 (Commonwealth)

“Goods” means the goods specified in the Invoice and includes any proceeds of sale or other disposal relating to the Goods and any parts and materials which may subsequently be supplied under any warranty given in relation to the Goods.

“IPR” means patents, rights and inventions, copyright and related rights, trade marks, trade and domain names, rights in get-up, rights in goodwill or to sue for passing off rights in designs, rights in computer software, database rights, rights in confidential information (including know-how and trade secrets) and any other intellectual or industrial property rights, in each case whether registered or unregistered and including all applications (or rights to apply) for, and renewals or extensions of, such rights and all similar or equivalent rights or forms of protection which now or in the future, subsist anywhere in the world.

“Invoice” means the invoice for the Goods.

 

  1. TRADING TERMS

The Customer agrees to comply with these terms and conditions.

  1. PAYMENT TERMS

Payments for Goods shall be made by the Customer to the Supplier as specified by the Invoice by which the Goods were purchased and at the time the Goods are purchased.

  1. GUARANTEE
    • The Goods are sold on an ‘as is’ basis.
    • Save for any terms, conditions, guarantees, warranties, indemnities or other rights which may arise under the Australian Consumer Law or other legislation and which cannot be excluded, all warranties, whether express or implied including warranties as to fitness for any purpose and merchantability are expressly excluded.
    • To the extent legally possible any liability that we may have to the Customer in relation to the Goods which cannot be excluded shall be limited to, at our discretion, either the replacement of the goods or supply of equivalent goods, the repair of the Goods, the payment of the cost of replacing the Goods or acquiring equivalent Goods, or the payment in cash of having the Goods repaired.
    • For the sake of clarity, clause 3 does not operate where contrary to the Australian Consumer Law
  2. CLAIMS
    • Subject to any rights that the Consumer may have to reject the Goods under the Australian Consumer Law:
      • the Customer will be deemed to have accepted the Goods unless it notifies the Supplier in writing of its claim within 7 days of receipt of the goods;
      • no return of allegedly defective or faulty Goods will be accepted by the Supplier unless the Supplier has given prior written authorisation for the return;
      • the Supplier does not provide a refund, credit or exchange to any Goods sold as clearance and sale goods, seconds, floor stock, repaired goods, or goods that have a defect where this has been drawn to the Customer’s attention before the purchase of the Goods;
      • the Supplier does not provide a refund, credit or exchange if you have damaged the Goods by using them in a way it was not meant to be used.
      • no refunds will be given if you have simply changed your mind.

If you receive a product that you believe is not what was expected we will replace the item or refund your money at our discretion. It will be your responsibility to return the item back to our Campbellfield location in its original packaging and in undamaged condition.

Should you object to any of these Terms and Conditions (including any subsequent amendments), you must immediately discontinue using this website.

  1. INTELLECTUAL PROPERTY RIGHTS

All confidential information, materials and IPR supplied by Supplier belong to the Supplier. Customer shall not use or have any rights in them other than to perform the Contract.

  1. PRICES

All prices quoted in the Supplier’s price lists are subject to change without notice. The Supplier reserves the right to amend prices. All prices are stated in Australian dollars (AUD) and include GST.

Should an item be listed incorrectly, the Supplier reserves the right to refund the customer for the transaction made on-line if goods have not been shipped or collected. 

  1. GST

The Customer must pay the GST which apply to the supply of any Goods by the Supplier to the Customer.

  1. SEVERABILITY

Any of the terms or conditions in this Contract which in any way contravene or infringe any law of the Commonwealth of Australia or the State of Victoria shall, to the extent of any such contravention or infringement and without affecting the remainder of this Contract be severable and severed from this Contract.

  1.  IMAGES

Images used on this site may not necessarily depict the actual product described, some images used are merely to convey a general product theme or lifestyle image. All images used are either owned by the Supplier or have been purchased under licence agreement.

  1. ON-LINE STORE PRIVACY POLICY

Furniture Warehouse Sale has committed ourselves to protecting your privacy. We use the information gathered to enable your account and to enhance your purchasing experience. Furniture Warehouse Sale will not sell its database of customer details or details about customers to any third party. Any and all the information collected on our website will be kept strictly confidential and will not be sold, reused, rented, disclosed, or loaned! We respect the right of users to remain anonymous and will endeavor not to knowingly disclose user identities unless directed by a court of law within Australia.

  1. DISCLOSURE OF COLLECTED INFORMATION

Furniture Warehouse Sale does not sell, trade, or rent your personal information to others. Furniture Warehouse Sale may release customer information when we believe, in good faith, that such release is reasonably necessary to (i) comply with law, (ii) enforce or apply the terms of any of our user agreements or (iii) protect the rights, property or safety of Furniture Warehouse Sale, our users, or others.

 

  1. WHAT INFORMATION DO WE COLLECT AND HOW WE DO WE USE IT?

When you place an order through this website, we need to know your name, e-mail, phone number, address and credit card details if paying by credit card. This allows us to process and fulfil your order. It also helps us in maintaining your correct account details.

  1. HOW DO WE PROTECT CUSTOMER INFORMATION? 

When you place orders, we use a secure server. The secure server software (SSL) encrypts all information you input before it is sent to us. Furthermore, several layers of encryption and several layers of security to prevent unauthorised access protect all of the sensitive customer data we collect.

  1. CREDIT CARD DETAILS

All credit card payments are processed securely through Woo-Commerce and the ANZ PAYMENT Gateway. Furniture Warehouse Sale does not store any credit card information on our servers.

  1. WHAT DO WE DO WITH "COOKIES"

‘Cookies’ are small pieces of information that are stored by your browser on your computer's hard drive. Our cookies do not contain any personally identifying information. Our credit card payment options available are safe and secure. We offer Credit Card processing, Direct Deposit, Cheque and Money Orders. Credit Card payments are made directly through our 128 bit SSL Encryption software to insure your personal details are kept safe. None of your payment details are stored; this ensures you will be safe with your on-line transaction/s.
